Deputy Chancellor Regulations 2017

Part 1 – Preliminary

1. Objective

The objective of these Regulations is to make provision for the appointment of more than one Deputy Chancellor as required by Statute 20(2) of the Governance, Academic and Student Affairs Statute 2013.

2. Authorising provision

These Regulations are made under the Governance, Academic and Student Affairs Statute 2013 and sections 28, 29 and 30 of the Victoria University Act 2010 (Vic).

3. Commencement

These Regulations come into operation on 24 August 2017.

Note:

Section 26 of the Interpretation of Legislation Act 1984 (Cth) provides for the exercise of powers between the making and commencement of a subordinate instrument.

4. Definitions

In these Regulations-
Deputy Chancellor means the person(s) who is appointed as a Deputy Chancellor in accordance with section 25 of the Victoria University Act 2010 (Vic).

Part 2 – Deputy Chancellors

5. Number of Deputy Chancellors

(1) The Council may appoint no more than three Deputy Chancellors to hold the office concurrently.

6. Powers if there are multiple Deputy Chancellors

(1) Where there are multiple Deputy Chancellors holding the office concurrently, the Council, by resolution, may specify which Deputy Chancellor is to exercise the powers in section 25 of the Victoria University Act 2010 (Vic).
(2)    Providing it is not in conflict with any resolution made under paragraph (1) of this Regulation, the Chancellor may determine which of multiple Deputy Chancellors holding the office concurrently are to exercise the powers in section 25 of the Victoria University Act 2010 (Vic).
(3)    In the absence of a resolution or a determination under paragraphs (1) and (2) respectively of this Regulation, the first appointed Deputy Chancellor will exercise the powers in section 25 of the Victoria University Act 2010 (Vic).
